The Canadian government is making significant updates to the eligibility criteria for open work permits (OWPs) for the family members of international students and foreign workers, set to take effect on January 21, 2025. These changes are designed to better align temporary resident programs with Canada's economic needs and labour market priorities. Here's a summary of the key updates:

Eligibility for International Students:

Spouses of international students will be eligible for an OWP if the student is enrolled in:

Master's programs that last 16 months or longer

Doctoral programs

Select professional or eligible programs

Eligibility for Foreign Workers:

Spouses of foreign workers can apply for an OWP if the worker is employed in:

TEER 0 or 1 occupations (management and professional roles)

Select TEER 2 or 3 occupations in sectors with labour shortages or that are government priorities, including:

Natural and applied sciences

Construction

Healthcare

Natural resources

Education

Sports

Military

A comprehensive list of eligible occupations will be published on January 21, 2025.

Additional Eligibility Requirements:

Foreign workers must have at least 16 months remaining on their work permit when their spouse applies for the OWP.

Dependent children of foreign workers will no longer be eligible for family OWPs.

Existing Permits and Renewals:

OWPs approved under previous criteria will remain valid.

In-Canada family members can renew their work permits if:

They apply under the same criteria as the current work permit.

The renewal duration matches that of the principal applicant’s study or work permit.

Exemptions:

Spouses of workers covered by free-trade agreements.

Spouses of workers transitioning to permanent residence.

Alternative Options:

Family members who no longer qualify for family OWPs can still apply for other work permits under Canada’s broader work permit programs.
